1. Acceptance of Terms
By accessing or using any Elite Web Systems service, product, or tool — including the EWS Lead Engine — the user agrees to be bound by these terms.
2. Services Description
Elite Web Systems provides web design, automation, AI integrations, and digital marketing services to businesses. The EWS Lead Engine is a SaaS prospecting tool that scrapes publicly available Google Business data for B2B outreach purposes.
3. User Responsibilities
Users are solely responsible for how they use leads, scripts, and data generated by Elite Web Systems tools. Users must comply with all applicable federal and state laws including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and any local cold calling or telemarketing regulations. Elite Web Systems tools are for B2B prospecting only and may not be used for spam, harassment, or unlawful purposes.
4. Intellectual Property
All content, code, design, and tools created by Elite Web Systems remain the intellectual property of Elite Web Systems unless otherwise agreed upon in writing. AI-generated scripts produced by the EWS Lead Engine are original outputs and are not reproductions of any third-party copyrighted material.
5. Disclaimer of Affiliations
Elite Web Systems and its tools are not affiliated with, endorsed by, or sponsored by any third-party sales trainers, coaches, software platforms, or organizations. Any methodology references are for descriptive purposes only.
6. Data and Privacy
Lead data surfaced by the EWS Lead Engine is sourced from publicly available Google Business listings. Elite Web Systems does not sell or share user data. Subscriber account data is stored securely and used only to provide access to purchased services.
7. Subscription and Billing
SaaS subscriptions are billed monthly through Stripe. Users may cancel at any time. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months. Elite Web Systems reserves the right to modify pricing with 30 days notice.
8. Limitation of Liability
Elite Web Systems is not liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use its services or tools. Results from lead generation and outreach are not guaranteed.
9. Modifications to Terms
Elite Web Systems reserves the right to update these Terms and Conditions at any time. Continued use of any service after changes are posted constitutes acceptance of the new terms.
10. Governing Law
These terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of Kern County, California.
